Nicolás Maduro and his wife face a June 2027 trial in Manhattan federal court on a four-count superseding indictment charging narco-terrorism conspiracy, cocaine importation conspiracy, and related weapons offenses. Both have pleaded not guilty. In early September 2026, defense counsel filed motions seeking dismissal on sovereign immunity grounds, with prosecutors due to respond by October 2 and oral arguments scheduled for November 17. The extended pretrial schedule, combined with pending challenges to jurisdiction and the legality of Maduro’s apprehension, creates multiple avenues for case dismissal or outcomes short of convictions on every count before the market’s December 2027 resolution deadline. Traders view these procedural barriers as the dominant factor supporting the current “No” consensus.
