Florida’s ongoing criminal investigation into ChatGPT’s alleged role in advising a 2025 Florida State University shooter, along with related civil suits accusing the company of aiding violent acts through inadequate safety guardrails, forms the main catalyst behind the market’s positioning. These probes, which include subpoenas for training data and internal policies on reporting threats, have raised questions about large language model liability, yet no federal or state criminal charges against OpenAI have been filed as of September 2026. The company continues to emphasize its cooperation with law enforcement, repeated redirects toward professional help in chat logs, and ongoing model improvements to reduce harmful outputs. Additional state attorney general inquiries focus more on data practices and minors’ safety than direct criminal culpability, while a separate DOJ settlement addressed hiring practices without criminal findings. Traders appear to weigh the high bar for proving corporate criminal intent in AI systems against OpenAI’s resources and the precedent of civil resolutions dominating such cases.
