New Jersey’s September 2, 2026, petition for certiorari places the Third Circuit’s ruling in KalshiEX LLC v. Flaherty squarely before the Supreme Court. That decision held that the Commodity Exchange Act preempts state sports-gambling laws when CFTC-registered platforms offer event contracts on sports outcomes, treating them as swaps under Dodd-Frank’s broad definition. Multiple states and tribes have signaled interest in the dispute, citing tensions with traditional state authority over gaming and the growth of retail prediction markets. Traders are now assessing whether the petition will generate a circuit split or attract the four votes needed for review amid competing federal and state regulatory claims. No conference date has been set, and resolution timing remains uncertain.
