Recent petitions filed in early September 2026 by New Jersey and conditionally by Robinhood seek Supreme Court review of whether the Commodity Exchange Act, as amended by Dodd-Frank, preempts state gambling laws for sports event contracts offered on CFTC-registered platforms like Kalshi. The Ninth Circuit’s August 28 ruling against Kalshi created a direct split with the Third Circuit’s April decision favoring federal exclusivity, raising the prospect of certiorari. Kalshi’s pending Ninth Circuit rehearing petition and ongoing CFTC rulemaking add procedural variables. The Court’s conference schedule and historical patterns for resolving regulatory preemption disputes will influence timing, with any grant needing public confirmation via the official docket before the July 31, 2026, market resolution date.
